This Release Form (hereinafter called the "Release"), is executed in date ... month ... year ..., by and between Jungle Boss Company Limited in Phong Nha, Quang Binh, Vietnam (hereinafter referred to as “Jungle Boss”) and the following

(Hereinafter referred to as “Customer”)

Whereas: Jungle Boss is in the travel and leisure business and, as part of the services it provides to its customers, it runs transport,  accommodation, jungle trekking, camping and caving activities; 

Whereas: The Customer wishes to partake in one or more of the services offered by Jungle Boss;  

Whereas: Jungle Boss is willing to enter into an arrangement with the Customer under the following specific condition:

1. The Customer accepts the authority of the Jungle Boss guide, management and staff and follows all cave & trekking rules without exception while participating in an Jungle Boss tour.

2. The Customer agrees that if they cannot complete any section of the tour due to lack of physical ability, they will be turned around at the discretion of Jungle Boss.

3. The Customer agrees Jungle Boss will not be responsible for any costs associated with booking alternative travel arrangements including hotels, flights, bus tickets or train tickets, if the tour is delayed and does not finish according to the dates/times as detailed on the tour itinerary, or the Customer is turned around due to lack of physical ability.

4. The Customer agrees to be fully responsible for the equipment (headlights, helmets, life jackets...) provided to them by Jungle Boss, and for their replacement costs if their equipment is lost or misplaced.

5. The Customer understands that Jungle Boss operates adventure tours requiring a high level of physical ability in a very remote location without medical facilities.

6. The Customer understands, acknowledges and agrees that adventure tourism activities such as trekking, camping and caving, etc. carry inherent risk factors and that dangers exist which are not related to safety equipment provided by the company. The Customer agrees that Jungle Boss cannot be held in any way responsible for any property damage, bodily harm, injury or death the Customer may sustain, either directly or indirectly, resulting from or in connection with any tour services provided by Jungle Boss.

7. The Customer acknowledges Jungle Boss will not accept responsibility or liability for any Customer who contravenes any laws or regulations of Vietnam.

8. The Customer understands that Jungle Boss may deem it advisable to amend an itinerary, and it may do so by varying or completely rerouting any tour from the scheduled itinerary. In this case, the Customer will make no objection or claim for compensation from Jungle Boss.

9. The Customer hereby releases, cancels, forgives and forever discharges Jungle Boss, and each of its directors, officers, heirs, successors and assigns in all capacities whatsoever, from all actions, claims, demands, damages, obligations, liabilities, controversies and executions, of any kind or nature whatsoever, whether known or unknown, whether suspected or not, which have arisen, or may have arisen, or shall arise, and the Customer does specifically waive any claim or right to assert any cause of action or alleged case of action or claim or demand which has, through oversight or error intentionally or unintentionally or through a mutual mistake, been omitted from this Release.

10. Alcoho & Drugs Policies

For safety reason, the following policies are applied for Jungle Boss tours 

- Jungle Boss DOES NOT recommend using alcohol or drugs during our tours

- Jungle Boss has the right to TERMINATE the tour immediately without refund if customers are using alcohol and drugs prohibited by Vietnamese law during tours.  

- Alcohol use policies on Jungle Boss tours 

- Each customer is only allowed to use 250ml of wine or 660ml of beer on each trip. 

- Alcohol is only allowed to use at campsite 

- Customers are responsible for any issue related to health or safety occurred from using alcohol. 

- For your safety, Jungle Boss has the right to immediately terminate the tour without refund in case (1) customers do not follow the alcohol & drugs policies issued by Jungle Boss; (2) Customers catch a serious problem occurred from using alcohol and drugs.

11. To ensure your absolute safety throughout your journey of exploring the wonders of nature, we would like to bring to your attention some important information:

Objective Factors:

During your tour, you may encounter objective factors such as:

- Weather: Heavy rain, storms, extreme heat...

- Natural disasters: Flash floods, landslides, earthquakes...

- Other factors: Insects, wild animals...

Safety Measures:

In the event of encountering any of the above objective factors, Jungle Boss tour guides will proactively:

- Update the situation: Continuously monitor and update information about the weather and natural disasters from official sources.

- Assess risks: Evaluate the level of risk and potential impact on the tour itinerary.

- Adjust the itinerary: If necessary, the tour guide will proactively adjust the itinerary, change locations, or cancel certain activities to ensure the safety of the entire group.

- Provide medical assistance: In case of emergency, the tour guide will contact the nearest medical facilities for timely assistance.

Recommendations for Guests:

- Prepare thoroughly: Pack adequate clothing, footwear, medicine, and other necessary items according to Jungle Boss's guidelines.

- Follow instructions: Always listen to and follow the tour guide's instructions in all situations.

- Stay calm: In the event of an incident, please remain calm and follow the tour guide's instructions.

Jungle Boss always prioritizes the safety of our guests. We are committed to accompanying you throughout your journey and providing the best possible experiences while ensuring your absolute safety.

12. The Customer agrees to the provisions of this Release and its recitals must be read as a whole and are not severable and/or separately enforceable by either party hereto.  

The Customer commits that he or she does not have heart attack, high blood pressure, asthma, osteoarthritis, seizure. If you have, please inform Jungle Boss for consulting.

The Customer agrees to give permission for Jungle Boss Company to use his/her likeness in photographs, video footage or electronic images in all forms, for media, advertising, and all other lawful purposes without compensation.

IN WITNESS WHEREOF, Jungle Boss and the customer agree to sign and implement this Release Form and it will take effect from the date of signing.
